Terms of service
Welcome to HYLTH Store! The terms "we", "us" and "our" refer to HYLTH Store, a trading name of HYLTH Ltd, a company registered in England and Wales (company number 17418464), registered office 128 City Road, London EC1V 2NX, United Kingdom. HYLTH Store operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). HYLTH Store is powered by Shopify, which enables us to provide the Services to you.
The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully. They include important information about your legal rights and about the limits of our liability. Nothing in these Terms affects your statutory rights as a consumer.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you should not use or access our Services.
Section 1 – Access and account
By agreeing to these Terms of Service, you confirm that you are at least 18 years old. If you allow anyone under 18 to use the Services on a device you own, buy or manage, you confirm that you have given them permission to do so.
To use the Services, including browsing our online store or buying any of the products we offer, you may be asked for certain information, such as your email address and your billing, payment and delivery details. You confirm that all the information you provide is correct, current and complete, and that you have the right to provide it.
You are responsible for keeping your account login details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.
Section 2 – Our products
Every HYLTH product is printed to order. We have made every effort to show our products accurately in our online store. However, colours may look different on your screen depending on the device you use and its settings.
Products will match their description. Because each item is printed individually, small variations are normal. Print position may differ by up to 2.5 cm (1 inch), and colours may vary slightly between batches. These variations are not treated as faults.
We may change product descriptions, or discontinue any product, at any time. Any change will not affect an order you have already placed. We may limit the quantities of any product we offer to any person, region or country.
Section 3 – Orders
When you place an order, you are making an offer to buy. We may accept or decline your order. Your order is accepted when we email you to confirm it, and we must receive your payment before we accept it. If we decline, change or cancel your order, we will contact you using the email address, billing address or phone number you gave us, and we will refund any payment in full.
Because items are printed to order, we can usually cancel an order only if you contact us within 12 hours of placing it. Your right to cancel, return or get a refund is set out in our Refund Policy, and is in addition to your legal rights.
You confirm that your purchases are for your own personal or household use, and not for commercial resale or export.
Section 4 – Prices and billing
Prices, discounts and promotions may change without notice. The price you pay is the price shown when you place your order, and it will be set out in your order confirmation email. We are not currently registered for VAT, so no VAT is added to our prices. The price shown is the full price of the item. Delivery charges are shown at checkout before you pay.
If your order is delivered outside the UK, it may be subject to import duties, taxes or customs charges in your country, unless those are shown and charged at checkout. Any such charges are your responsibility.
Prices in our online store may differ from prices offered elsewhere, such as stores run by third parties. From time to time we may run promotions with their own terms, separate from these Terms. If a promotion's terms conflict with these Terms, the promotion's terms apply.
You agree to give current, complete and accurate payment and account information for all purchases, and to update it promptly so that we can complete your orders and contact you if needed.
You confirm that (i) the payment card information you provide is true, correct and complete, (ii) you are authorised to use that card for the purchase, (iii) your card issuer will honour the charges, and (iv) you will pay the charges incurred at the posted prices, including delivery and any applicable taxes.
Section 5 – Shipping and delivery
Delivery times shown in our store are estimates. Unless we agree a different date with you, we will deliver your order within 30 days of accepting it. If we can't, we will tell you, and you may cancel for a full refund.
The products are our responsibility until they are delivered to you, or to someone you have nominated to receive them. Ownership passes to you once we have received full payment, and the risk passes to you on delivery.
We are not responsible for delays caused by events outside our reasonable control, such as severe weather, carrier strikes or customs processing. If such an event happens, we will contact you, and you may cancel for a full refund if the delay is significant.
If your parcel is lost, damaged or delayed, see our Refund Policy for what to do.
Section 6 – Intellectual property
Our Services, including all trademarks, brands, text, displays, images, graphics, product designs, product reviews, video and audio, and their design, selection and arrangement, are owned by HYLTH Store, its affiliates or licensors. They are protected by UK and international copyright, trademark and other intellectual property laws.
These Terms allow you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent. Except as expressly stated here, nothing in these Terms grants you a licence or any other rights under any patent, trademark, copyright or other intellectual property of HYLTH Store, Shopify or any third party. All rights not expressly granted are reserved by HYLTH Store.
HYLTH Store's names, logos, product and service names, designs and slogans are trademarks of HYLTH Ltd or its affiliates or licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.
Section 7 – Optional tools
You may be given access to customer tools offered by third parties as part of the Services. We do not monitor these tools and have no control or input over them.
We provide access to such tools "as is" and "as available", without any endorsement. To the extent the law allows, we are not liable for anything arising from your use of optional third-party tools.
Any use of optional tools offered through the site is at your own risk and discretion. You should make sure you are familiar with, and approve of, the terms on which the relevant third-party provider offers them.
We may also offer new features through the Services in future, including new tools and resources. These will also form part of the Services and are subject to these Terms of Service.
Section 8 – Third-party links
The Services may contain materials and links to websites provided or operated by third parties, including embedded third-party features. We are not responsible for checking or evaluating the content or accuracy of any third-party materials or websites. If you leave the Services to access them, you do so at your own risk.
We are not liable for any harm or damage related to your use of third-party websites, or your purchase or use of any products, services, resources or content on them. Please review the third party's policies and practices carefully before you make any transaction. Complaints, claims, concerns or questions about third-party products and services should be directed to the third party.
Section 9 – Relationship with Shopify
HYLTH Store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with HYLTH Store. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and HYLTH Store, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with HYLTH Store.
Section 10 – Privacy policy
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them for you. Information you submit to the Services will be sent to and shared with Shopify, and with third parties that may be located in countries other than the one where you live, in order to provide services to you. These third parties include our print and delivery partner, which makes and ships your order. Our Privacy Policy explains in more detail how we, Shopify and our partners use your personal information.
Section 11 – Feedback
If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, proposals, plans or other content (together, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use. For example, we may use this licence to operate, provide, evaluate, enhance, improve and promote the Services, and to perform our obligations and exercise our rights under these Terms of Service.
You also confirm that: (i) you own, or have all the necessary rights to, your Feedback; (ii) you have disclosed any payment or incentive you received in connection with it; and (iii) your Feedback complies with these Terms. We are under no obligation (1) to keep your Feedback confidential; (2) to pay for your Feedback; or (3) to respond to your Feedback.
We may, but are not obliged to, monitor, edit or remove Feedback that we reasonably decide is unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms of Service.
You agree that your Feedback will not infringe the rights of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights. You also agree that your Feedback will not contain defamatory or otherwise unlawful, abusive or obscene material, or any computer virus or other malware that could affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone else, or otherwise mislead us or third parties about the origin of any Feedback. You are responsible for any Feedback you make and for its accuracy. We are not responsible for Feedback posted by you or any third party.
Section 12 – Errors, inaccuracies and omissions
Occasionally, information on the Services may contain typing errors, inaccuracies or omissions. These may relate to product descriptions, pricing, promotions, offers, delivery charges, delivery times or availability. We may correct any such error, and change or update information, at any time without prior notice.
If we find an obvious error in the price or description of a product you have ordered, we will contact you. You can then confirm the order at the correct price, or cancel it. If you cancel, or we cannot reach you, we will cancel the order and refund you in full.
Section 13 – Prohibited uses
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any international, national or local law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, disparage or intimidate any of our staff or any other person; (e) to send false or misleading information; (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms; (g) to send, or arrange the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam" or similar solicitation; (h) to impersonate, or attempt to impersonate, any other person or organisation; or (i) to engage in any other conduct that restricts or prevents anyone's use or enjoyment of the Services, or which we reasonably decide may harm HYLTH Store, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other malicious code that will or may affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm or pretext the Services; (e) use any robot, spider, scraper, data-gathering or extraction tool, automatic device or process, AI tool (such as agentic AI), or other automated means to access the Services, except as permitted in Section 14; or (f) interfere with, bypass or circumvent the security or authorisation features, robot exclusion headers, or other measures we use to restrict access to the Services. We may suspend, disable or close your account at any time, without notice, if we reasonably decide that you have breached any part of these Terms.
Section 14 – Agents
14.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can run on behalf of, or using, a person's device without direct supervision.
14.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates strictly in accordance with the requirements in section 14.4 below. In addition, no Agent may access, use or interact with the Services if we have asked it not to.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request comes from an Agent and disclose the Agent's name, by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obscure that any access, use or interaction comes from an Agent, for example by (a) mimicking human behaviour and interaction patterns, or (b) completing or circumventing CAPTCHAs or other measures intended to tell computers and humans apart; (iii) respond truthfully to any question or prompt asking whether interactions are coming from a human or a computer; and (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify or control whether and how Agents access, use or interact with the Services.
Section 15 – Termination
We may end this agreement, or your access to the Services or any part of them, at any time and without notice. You will remain liable for all amounts due up to and including the date it ends. Ending your access does not affect any order we have already accepted, or your legal rights in relation to it.
The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
Section 16 – Disclaimer of warranties
The information on or through the Services is provided for general information only. It is not professional, medical or fitness advice. We do not promise that it is accurate, complete or useful, and you rely on it at your own risk.
We do not promise that your use of the Services will be uninterrupted, timely, secure or error-free.
This section does not affect the products you buy from us. Under the law, the products must be as described, of satisfactory quality and fit for purpose. If they are not, you have legal rights, and nothing in these Terms limits them. Our Refund Policy explains how to use those rights. For advice about your rights in the UK, contact Citizens Advice.
Section 17 – Limitation of liability
If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence. Loss or damage is foreseeable if it is obvious that it will happen, or if we both knew it might happen when the contract was made. We are not responsible for loss or damage that is not foreseeable.
We supply products for domestic and private use only. We are not liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence, or the negligence of our employees, agents or subcontractors; (b) fraud or fraudulent misrepresentation; (c) breach of your legal rights in relation to the products, including the right to receive products that are as described, of satisfactory quality and fit for purpose; or (d) defective products under the Consumer Protection Act 1987.
To the extent the law allows, the same limits apply to our directors, employees, agents, contractors, service providers and licensors, and to Shopify and its affiliates.
Section 18 – Indemnification
If you deliberately misuse the Services in breach of Section 13, or submit Feedback that infringes someone else's rights or is unlawful, you agree to compensate HYLTH Store, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers. This covers any losses, damages, liabilities or claims (including reasonable legal costs) that a third party brings against us as a result.
We will tell you promptly about any such claim, and will not settle it in a way that requires you to do anything other than pay money without your agreement, which you will not unreasonably withhold. You agree to cooperate with us in defending the claim, including by providing relevant documents.
Section 19 – Severability
If a court or other relevant authority decides that any provision of these Terms of Service is unlawful, void or unenforceable, that provision will still apply to the fullest extent the law allows. Any part that cannot apply will be treated as removed from these Terms of Service. This will not affect the validity and enforceability of the remaining provisions.
Section 20 – Waiver; entire agreement
If we do not exercise or enforce any right or provision of these Terms of Service, that does not mean we have waived it. We may still enforce it later.
These Terms of Service, together with any policies or operating rules we post on this site or about the Services, form the entire agreement between you and us. They govern your use of the Services and replace any earlier agreements, communications and proposals between you and us, whether spoken or written, including any earlier versions of these Terms of Service. This does not affect any statement we made that you relied on when placing your order.
If any part of these Terms could be read in more than one way, the meaning most favourable to you will apply.
Section 21 – Assignment
You may not transfer or assign this agreement, or any of your rights or obligations under these Terms, without our prior written consent. Any attempt to do so will have no effect.
We may transfer our rights and obligations under these Terms to another organisation. If we do, we will tell you, and we will make sure the transfer does not affect your rights under these Terms. If you are unhappy with the transfer, you may contact us to end the contract, and we will refund you for any products you have paid for but not received.
Section 22 – Governing law
These Terms of Service, and any separate agreements under which we provide you with Services, are governed by the law of England and Wales. You can bring legal proceedings about the Services in the courts of England and Wales.
If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring them in either the Northern Irish or the English courts.
If you live in the European Union, you will also benefit from any mandatory consumer protection provisions of the law of the country where you live, and you can bring legal proceedings in the courts of that country.
Section 23 – Headings
The headings in this agreement are included for convenience only. They do not limit or otherwise affect these Terms.
Section 24 – Changes to Terms of Service
You can review the most current version of the Terms of Service at any time on this page.
We may update, change or replace any part of these Terms of Service by posting the changes on our website. Please check our website from time to time. We will tell you about any material changes in accordance with the law, and they will take effect on the date stated in that notice. If you continue to use or access the Services after changes are posted, you accept those changes.
The Terms in force when you place an order apply to that order. Any later change will not affect an order you have already placed.
